Super Extreme DUI
(A.R.S. 28-1382)
A super extreme DUI applies when the BAC is 0.20 or above. First-offense penalties include 45 days in jail, fines around $2,750, and interlock requirements extending up to 18 months. Second offenses within the 84-month lookback window carry even harsher sentences. These cases often involve significant impairment, and the state prosecutes them aggressively.
Actual court costs often exceed these base amounts once mandatory surcharges and assessments are added (typically 15–20% higher).
What many people do not realize is that a single traffic stop can result in multiple DUI charges. If your BAC was 0.22, for example, the state can charge you with a standard DUI, an extreme DUI, and a super extreme DUI simultaneously. You will not be sentenced on all three, but the charging strategy gives prosecutors leverage in negotiations.
